NOTICE OF SALE OF REAL ESTATE

WHEREAS, by deed of trust dated December 15, 2017, of record in Volume 1320 at page 9 in the Register’s Office of Dickson County, Tennessee (the “Deed of Trust”), Terry Sue Alberd conveyed the hereinafter-described real estate (the “Property”) to Barney B. Regen, Trustee , to secure the payment of the indebtedness evidenced by a promissory note of even date therewith executed by the grantor and made payable to First Federal Bank, together with all renewals, extensions, and modifications thereof (collectively, the “Note”); and

WHEREAS, by instrument dated October 26, 2022, of record in Volume 1548 at page 2211 in the Register’s Office of Dickson County, Tennessee, Benjamin C. Regen was appointed successor trustee under the Deed of Trust (the “Successor Trustee”); and

WHEREAS, default has occurred in the payment of the Note and other provisions of the Deed of Trust have been violated, and First Federal Bank, the owner and holder of the Note, has declared the entire indebtedness due and payable, and has directed the Successor Trustee to foreclose the Deed of Trust in accordance with the terms thereof;

THE PUBLIC IS HEREBY NOTIFIED that the Trustee will sell the Property at public auction to the highest and best bidder for cash at the front door of the Dickson County Justice Center, 500 Spring Street, Charlotte, Tennessee, at the hour of 3:00 p.m. prevailing central time on Friday, May 26, 2023, in bar of the Grantor’s right and equity of redemption, and subject, inter alia, to all liens, encumbrances, and other defects in title having priority or preference over the Deed of Trust, including any lien for unpaid real property taxes; to the rights of tenants in possession, if any; and to all applicable and enforceable laws of governmental authorities having jurisdiction of the Property, whether or not such matters are disclosed by the public records of the county wherein the Property is located.

The Property is described in the Deed of Trust as follows:

Lying and being in the Sixth Civil District of Dickson County, State of Tennessee, being Lot No. 1 of the Ruby Spann Heirs Subdivision as shown on plat of record in Plat Cabinet F, Slide 399, in the Register’s Office of Dickson County, Tennessee, to which reference is hereby made for a complete description.

Being part of the same property conveyed to Clifford Spann and wife, Ruby Spann, by warranty deed from W. J. Spann and wife, Bell Spann, dated July 11, 1949, of record in Deed Book 79, Page 103, in the Register’s Office of Dickson County, Tennessee. Also being the same property title to which vested in Ruby Spann upon the death of her husband, Clifford Spann, deceased, by reason of their tenancy by the entirety. Also being the same property devised to Terry Sue Spann Alberd, by the Last Will and Testament of Ruby Spann, deceased, dated August 12, 1999, of record in Will Book U, Page 690, in the Probate and Juvenile Court for Dickson County, Tennessee.

The Property is subject to restrictions and reservations of record in Volume 768, Page 138, in the Register’s Office of Dickson County, Tennessee.

The Property is further subject to all matters as shown on plat of record in Cabinet F, Slide 399, in the Register’s Office of Dickson County, Tennessee.

The Property is further subject to the right-of-way of Rock Church Road.

The Property is further subject to an easem*nt in favor of Dickson County Water Authority, and of record in Volume 672, Page 996, in the Register’s Office of Dickson County, Tennessee.

The address of the Property is believed to be 1816 Rock Church Road, Charlotte, Tennessee, but such address is not part of the legal description by which the Property will be sold, and in the event of a discrepancy between the legal description and the street address, the legal description will control.

The Property is believed to be identified as Map 083-00-015.00 on the Dickson County tax map.

The Property is believed to be improved.

The right is reserved to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the sale above; to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the adjourned sale; and to repeat this process from time to time until the Property is sold by the Successor Trustee, or until the expiration of one (1) year following the originally scheduled date of sale, whichever occurs first.

If the highest bidder does not pay the bid price within twenty-four (24) hours of the sale, the right is reserved to sell the Property to the next highest bidder who is ready, willing, and able to purchase the Property for cash.

The record owner of the Property is Terry Sue Spann Alberd.

There is no record holder of any mortgage, deed of trust, or other lien which will be extinguished or adversely affected by the sale of the Property, and which mortgage, deed of trust, or lien, or notice or evidence thereof, was recorded in the public records of Dickson County, Tennessee, more than ten (10) days prior to the first advertisem*nt of notice of sale, except Capital One Bank, Republic Finance, LLC, US Community Credit Union, Dickson County Director of Sanitation, and the heirs and devisees of Terry Sue Alberd, deceased.

The Successor Trustee is unaware of any other party whose rights will be adversely affected by the sale of the Property pursuant to this notice.

The Successor Trustee is considered a debt collector within the meaning of the Fair Debt Collection Practices Act. Accordingly, this notice is from a debt collector attempting to collect a debt and any information obtained will be used for that purpose.
